A Guide To Virginia's Medicaid Waivers For Persons With Disabilities, Their
Parents, and Caregivers

This July 2007 guide focuses
on five of the waivers currently available in Virginia. It gives an
excellent overview of the services provided under these waivers and how to
apply for them.
- Mental Retardation (MR) Waiver
- Day Support Waiver (For People with MR)
- Individual and Family Developmental
Disabilities Support (IFDDS or DD) Waiver
- Elderly or Disabled with Consumer Direction
(EDCD) Waiver
- Technology-Assisted (Tech) Waiver

EARLY AND PERIODIC SCREENING,
DIAGNOSIS, AND TREATMENT SERVICES (EPSDT)
EPSDT is a comprehensive
and preventive child health program for individuals under the age of 21. EPSDT
includes periodic screening, vision, dental and hearing services. Under the Social Security Act Section 1905(r)(5), states are required to provide
any medically necessary health care services listed at section 1905 (a) of the
Social Security Act to correct and ameliorate physical and mental conditions
even if the service is not included under the state’s Medicaid plan.

The Regulations Governing Special Education
Programs for Children with Disabilities in Virginia, effective March 27,
2002, (the Virginia Regulations), must be revised to comply with the changes
outlined in the Individuals with Disabilities Education Improvement Act of 2004
(IDEA ’04), and its federal implementing regulations. For additional

BUDGET UPDATE
The
Budget Conference Committee report has just become available and we have very
good news to share!
The new Budget Bill includes:
-
600 Medicaid MR Waiver slots to become available in
the first year of the biennium
-
3.6% Medicaid MR Waiver reimbursement rate increase for group
homes
-
MR Waiver Start-up funds:
$1.6M in FY09 and $800,000 in FY10
-
Language to realign the Medicaid Waiver Supported
Employment reimbursement rate to be consistent with rates established by DRS
-
Language for a DMHMRSAS report on community-based
housing for people with intellectual and developmental disabilities

THE R-WORD BILL PASSES!!!
(Replacing the term Mental Retardation with Intellectual Disability in the Code
of Virginia)

Erin and Jill in the Gallery at the Senate of Virginia
Legislation to erase the terms "mentally retarded" and "mental retardation" from
state law has won final General Assembly approval.
The legislation includes a reenactment clause, which means it will become law
only if the General Assembly passes it again next year and the Governor signs
it. Legislators were overwhelming in favor of this change and expect it to pass
quickly next year. Congratulations
to everyone who worked to support this bill.
Thanks to Senator Ticer, Senator Howell, and Delegate Caputo who were the chief patrons
of these bills. Please let them know you appreciate their support!
